INSTASENT MOBILE ADVERTISING, S.L. hereby informs you of its privacy policy applied to personal data.

This Privacy Policy applies to the processing of personal data in general, except as provided in the Data Processing Annex included in the General Terms and Conditions contract, which specifically regulates the processing carried out by Instasent as the Processor on behalf of the Customer.

In the event of any conflict between the provisions of this Privacy Policy and those of the Data Processing Annex, the provisions of the Annex will prevail with regard to the processing of the Customer’s Personal Data.

Furthermore, this policy regulates how we use personal data, the reasons why we share personal data, and how you can access and control the same.

INSTASENT will also access customer databases that you share on the platform for the purpose of providing services. In this capacity, INSTASENT will act as the Processor of that personal data. Your customers’ personal data will be treated with absolute confidentiality and in compliance with the duty of secrecy.

The Data Controller of that data is the Customer who contracts the services provided by INSTASENT.

2. To handle requests or queries submitted via the various means incorporated into our Platform

The processing of your data is necessary for the execution of the service provision contract that binds us to you. We believe that processing this data is positive for all parties involved when payment for a purchase/subscription occurs, and particularly for you, as it allows us to implement appropriate measures to protect you against attempts of fraud by third parties.

1. Development, fulfillment, and execution of the service provision contract

We will process your data for as long as necessary to manage the purchase/subscription of services you have acquired and subsequently for the legally established timeframes to comply with our tax obligations. In some cases, we will process only specific data until you decide otherwise, such as for payment data (bank card) that you have asked us to store for future purchases.

2. Customer Service

We will process your data for as long as necessary to handle your request or query.

3. For website registration

We will process your data for as long as you maintain the status of a registered user (i.e., until you decide to cancel your account).

4. Marketing

We will process your data until you request to unsubscribe or cancel your newsletter subscription. If you participate in promotional actions, we will retain your data for six (6) months after the action ends.

Regardless of the fact that we process your data for the time strictly necessary to fulfill the corresponding purpose, we will subsequently retain it, duly stored and protected, for as long as liabilities arising from the processing may arise, in compliance with the regulations in force at all times. Once any potential actions have expired in each case, we will proceed to delete the personal data.

Will we share your data with third parties?

To fulfill the purposes indicated in this Privacy Policy, it is necessary for us to provide access to your personal data to third parties who support us in the services we offer, as detailed below:
